Confirming Willingness and Awareness

The notary must make sure the signer is signing voluntarily and understands what they are signing.

The signer must:

  • Understand what the document is
  • Be signing of their own free will
  • Not be under pressure, threat, or coercion
  • Be mentally aware and competent at the time of signing

If there is any doubt about willingness or awareness, the notarization must be refused. For example, if a signer seems confused, heavily medicated, or is being pushed by another person, do not proceed.
